Comment period opens for proposed hazardous materials regulation revision

On Thursday, April 26, 2012, a Notice of Proposed Rulemaking (NPRM) titled, “Hazardous Materials; Miscellaneous Amendments (RRR)” will be published in the Federal Register. This NPRM proposes to revise the Hazardous Materials Regulations (HMR) to make miscellaneous amendments to update and clarify certain regulatory requirements. These amendments promote safe transportation practices; eliminate unnecessary regulatory requirements; address a petition for rulemaking; incorporate a special permit into the HMR; facilitate international commerce; and simplify the regulations. The amendments proposed in this NPRM also include updating various entries in the Hazardous Materials Table and corresponding special provisions, clarifying the lab pack requirements for temperature-controlled materials, harmonizing the requirements for air shipments of certain alcoholic beverages, and revising the training requirements to clarify that a hazardous material employer must make hazardous materials employee training records available upon request to an authorized official of the Department of Transportation or the Department of Homeland Security. PHMSA anticipates that the amendments contained in this rule will generate economic benefits to the regulated community.
